Terms of use for foodfool.org
§ 1 Scope, provider
(1) These terms of use govern the use of the online application provided via the domain foodfool.org and all features and services offered through it.
(2) The provider and operator is Vincenzo Auricchio, Margaretenstraße 28, 82152 Krailling, Germany, email: kontakt@foodfool.org.
(3) FoodFool is a private, non-commercial hobby project and is intended for private users.
§ 2 Subject of the service
(1) FoodFool is an application for recording, organizing, and managing food items and supplies across different storage locations and households in order to reduce food waste.
(2) The service provides technical features for personal use only. No goods are sold and no contracts between users are brokered or processed.
§ 3 Registration and user account
(1) Use of essential features requires a user account. There is no entitlement to registration, activation, or permanent use.
(2) Users are obliged to provide truthful information when registering, to keep their login credentials confidential, and to protect them from access by third parties.
§ 4 User obligations, prohibited use
(1) Users agree to use the service only within the scope of applicable law and these terms of use.
(2) In particular, it is prohibited to:
- post unlawful, offensive, or rights-infringing content,
- circumvent technical protective measures,
- use automated access, scraping, or bots,
- disrupt the operation of the service or infrastructure,
- create multiple accounts to circumvent blocks.
§ 5 User content
Users are solely responsible for the content they post and warrant that it does not infringe third-party rights or violate legal provisions.
§ 6 Availability, no warranty
(1) FoodFool is provided as a free hobby project without warranty and "as is". There is no entitlement to uninterrupted, error-free, or permanently consistent availability.
(2) Maintenance, security updates, technical disruptions, and changes to infrastructure or software may lead to restrictions or outages.
(3) The provider reserves the right to change, expand, restrict, or discontinue features at any time, or to discontinue the service entirely, provided that mandatory statutory rights of users are not violated.
§ 7 Data backup, data loss
Users are responsible for backing up their important data themselves. The provider accepts no liability for the loss of content stored in the application, to the extent permitted by law.
§ 8 Free of charge
Use of the service is free of charge. There is no obligation to provide the service free of charge permanently.
§ 9 Usage rights to content
By posting content, the user grants the provider a simple, non-exclusive right limited to the duration of use to use the content for operation, technical processing, storage, and display within the application, to the extent necessary to provide the service.
§ 10 Liability
(1) The provider is liable without limitation in cases of intent and gross negligence, for injury to life, body, or health, and in cases of mandatory statutory liability.
(2) In the event of slightly negligent breach of essential contractual obligations, liability is limited to foreseeable, typical contractual damage. Essential contractual obligations are those whose fulfillment enables proper performance of the usage relationship in the first place and on whose compliance the user may regularly rely.
(3) Otherwise, liability is excluded.
§ 11 Term, termination
(1) The usage relationship runs for an indefinite period. Users may delete their account at any time or request deletion. You may also request deletion of your data at any time by sending an email to kontakt@foodfool.org.
(2) The provider may suspend or terminate user accounts with effect for the future where there is good cause, and without notice in cases of serious violations.
§ 12 Privacy
Information on the processing of personal data is contained in the separate Privacy Policy.
§ 13 Consumer dispute resolution
The provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 14 Changes to these terms of use
The provider reserves the right to amend these terms of use with effect for the future where necessary for good cause, in particular due to legal changes or technical developments. Registered users will be informed of material changes in good time.
§ 15 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions provide otherwise.
(2) Should individual provisions be or become invalid, the validity of the remaining provisions shall remain unaffected.
